We want our customers to be satisfied with our products and services. This principle determines our actions, because we want our customers to come back again and again..... and recommend us to their family and friends.

We want you to be happy with your purchase: if it doesn't suit you for any reason, you can return it within 14 days of receipt and be refunded immediately (of course, in the box, in perfect condition and unused). If it is damaged, please contact us as soon as possible.

These terms and conditions govern the contractual relationship between Brendan Collis and any person making a purchase through this website. They may be modified at any time. They apply, without restriction or reservation, to all sales of the products offered on this website. An order placed through this website implies full and complete acceptance of these terms and conditions of sale. The buyer acknowledges having read them prior to placing an order.

2: Formation of the contract and orders


Prices

  • The prices are indicated in Euros, and are those in force at the time of the registration of the order by the Buyer.
  • The prices indicated include shipping costs where indicated.
  • VAT is not applicable, www.shade-sail-boutique.co.uk is a commercial web site of Brendan Collis, Registered in Switzerland as independent (Canton of Vaud 1644894-30/CHE-389.582.350).
  • The selling prices of the products can be changed at any time. This modification will be notified to the buyer before any order is placed.

Product characteristics

    The offers presented are valid while stocks last. If the product is not available, we undertake to inform the Buyer as soon as possible by any means at his convenience.
  • The photographs, graphics and descriptions of the products offered for sale are only indicative and are not binding on the seller.

Orders

  • Any validated order presupposes adherence without restrictions or reservations to the present general conditions of sale. The sale will be considered final after confirmation of the order dispatch.

3: Payment


  • Payment of the full price must be made when the order is placed.

4: Delivery and Receipt


General Rules

  • The products will be delivered to the address indicated by the Buyer when the payment is made.
  • In the event of partial availability of items, we will inform you as soon as possible and agree a delivery plan schedule.
  • Customers should ensure that the products delivered are in good condition. If the package has been damaged in the post then delivery should be refused and we ahould be notified immediately.

Delivery timescales

  • Your order will normally be dispatched within 2 working days. Delivery should occur 2 to 3 days after dispatch.
  • These deadlines are given for information only. A delay does not entitle the buyer to cancel the sale, to refuse the goods or to benefit from damages.

Quality or compliance problems

  • In the event of delivery of a product that does not correspond to the order (defective or non-compliant), the Buyer must make his complaint within 14 days from the date of receipt of the goods.
  • Complaints should be sent using the contact form on the website and must include the order reference, the contact details of the Buyer, the product references and the reasons for the complaint.
  • Products must be returned within seven working days of notification.
  • Failing this, we will not exchange or reimburse the products thus ordered.
  • Any product to be exchanged or refunded must be returned to our warehouse in its original condition and include all the product and its accessories.
  • Shipping costs are at the expense of the buyer.
  • Any risk related to the return of the product is the responsibility of the Buyer.
  • Failure to comply with the procedure set out above and the time limits indicated will prevent the Buyer from making any claim for non-conformity or apparent defect of the products delivered, the products being then deemed to be in conformity and free of any apparent defect.

5: Right of Withdrawal


  • The right of withdrawal may not apply to all supplies of goods made to specifications of the consumer or clearly personalised. Thus, no right of withdrawal will be granted for custom-made and/or non-standard products.
  • the Buyer has a period of seven clear days from the date of receipt, to return the ordered products in therir original packaging adn condition at its expense.
  • The products must imperatively be returned to our depot in perfect condition for resale, in their condition original (packaging, accessories, instructions, etc.), duly sealed, and accompanied by the invoice corresponding to the purchase.
  • Any product that is incomplete, damaged or whose original packaging has been damaged will not be refunded or exchanged.
  • The exercise of the right of withdrawal will give rise to a refund.

6: Retention of title


  • Brendan Collis retains full and complete ownership of the products sold until full payment has been received, including all principal, costs and taxes. During the period between delivery and transfer of ownership, the risks of loss, theft or destruction are the responsibility of the buyer.

7: Guarantee


  • Products are guaranteed against mechanical failure for a period of one year. Accidental damage of damage caused by incorrect use is not covered. Return postage charges are the responsibility of the customer.
  • The general terms and conditions and the duration of the guarantee are available on this website.
  • The Buyer shall be deemed to have consulted and accepted them.
  • Any return of the product under the aforementioned guarantee must be subject to prior agreement. To this end, the Purchaser will contact the Purchaser via the website.
  • No returns will be accepted without prior authorisation.
  • All costs and risks related to the return of the product are the responsibility of the Buyer.
  • The product under warranty will, at the manufacturer's choice, be exchanged or repaired.
  • Excluded from the guarantee :
    • The abnormal and improper use of the products.
    • Damage that is specifically mentioned in the product data sheets.
    • Defects and their consequences due to the intervention of the Buyer or an unauthorised repairer in advance.
    • Defects and their consequences related to the use not in accordance with the intended use of the product.
    • Products covered by a specific assistance and maintenance contract.

8: Applicable Law


  • For the foreign Purchaser, it is up to him to check with the local authorities the possibilities of using the product he intends to order.
  • The responsibility could not be engaged in case of non-respect of the regulations of a foreign country where the product is delivered.
    • We cannot be held responsible for the non-fulfilment of the contract in case of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike in particular of the services postal and means of transport and/or communications.
    • We will not be responsible for any loss of data or files. It is up to the Buyer to make all necessary backups.
  • The total or partial impossibility to use the products, in particular due to an incompatibility of equipment, cannot engage the responsibility of Brendan Collis nor give rise to any compensation or reimbursement.

9: Data Privacy


  • The information collected by the website during any order by the Purchaser is necessary for the management of his order.
  • In accordance with the French Data Protection Act n°78-17 of 6 January 1978, the Buyer has the right to access, rectify, oppose and delete data concerning him/her.
